Booking terms and conditions

All Adventures (as defined herein) are operated by Love Travel Adventures Ltd (LTA), trading as ‘Love Travel Adventures’ and are sold subject to the following terms and conditions:

  1. These Terms & Conditions

These are the terms and conditions on which we supply travel and tour booking and arrangement services to you. Please read these terms carefully and raise any queries you may have before you seek to confirm your booking as they set out our respective rights and obligations to you, what to do if there is a problem, how you and we may change or end the contract and other important information.

We are Love Travel Adventures Ltd a company registered in Scotland with company number SC686393 and our registered office is at 2 Pitlethie Road, Leuchars, St Andrews, Fife, Scotland, KY16 0EZ You can contact us by telephoning us at 01334 807093 or by writing to us at craig@lovetraveladventures.co.uk or 2 Pitlethie Road, Leuchars St Andrews Fife Scotland KY16 0EZ.

If we have to contact you we will do so by telephone or writing to you at the email address or postal address you provided to us with your booking when we use the words “writing” or “written” in these terms, this includes email.

  1. Your Adventure Contract with LTA

The contract for your Adventure will be with Love Travel Adventures Ltd, a member of Protected Trust Services (No. 5664 ). Our acceptance of your booking will take place when we issue a confirmation invoice to you, at which point a legally binding contract between us will come into existence. The Trip Notes relevant to your Adventure and our Booking Information (available on our website) also form part of our contract. Our contract is with you as the individual placing the booking for your Adventure (the “Lead Name”). As Lead Name, by acceptance these terms and conditions you are accepting that you have the authority and undertake responsibility for all persons named on the booking. The Lead Name is also responsible for the accuracy of all information provided to us, providing information to all persons named on the booking and for making all payments when due.

Your confirmation invoice will be sent to the Lead Name of your tour party. Please check this invoice carefully as soon as you receive it and contact us immediately if any information which appears on this or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracies (for which we are responsible) in any document within 10 days of our sending it out. We will do our best to rectify any mistake notified to us outside these time limits, but you must meet any costs involved in doing so.

In the event that you wish to change the name of any party on the Adventure more than 61 days before your departure, you will be charged an administrative fee of £50. In the event that you wish to change the name of any party on the Adventure less than 61 days before your departure, you will be charged an administrative fee of £100.  In addition, you will be liable for any additional costs incurred by us when processing transfer requests. You will be notified of any additional costs prior to the transfer request being processed.

In these booking conditions, “you” and “your” means all persons named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. “We”, “us” and “our” or “LTA” means Love Travel Adventures Ltd. References to “Adventure” are to the arrangements we contract to arrange or provide for you before you go away and references to “arrival in country” are to the start date of these arrangements. 

We are not responsible for any advice given to you by your travel agent that did not originate from us. 

  1. Our responsibility

The Adventures operated or supplied by LTA have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of personal risk and exposure to potential hazards over and above those associated with normal ‘package’ Adventures. To ensure the best experience for you, we deal directly with a ground handler, who will be responsible for the day to day logistics  during the course of your Adventure, such as accommodation, transfers and excursions. They will be your main point of contact during your Adventure.

All bookings are accepted on the understanding that such risks and hazards are appreciated by you and you undertake all tours, hikes, and other activities at their own choosing. We cannot not be held responsible if you are not fit enough to partake in any particular activity. However, you can make a request for alternative activities to be booked. This is subject to an administrative fee of £50 for each change in activity that is requested. In addition, you will be liable for any additional costs incurred by us as a result of changing an activity on your Adventure.

Please contact us prior to booking if you have any concerns regarding your ability to participate in any activities. We endeavour to make reasonable adjustments to accommodate and cater for everyone. Please refer to clause 8 for further information.

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill in organising and booking your Adventure, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the booking process.

We are not liable to you for any loss or damage caused by any external third party supplier that you engage during the course your Adventure. Foreign and Commonwealth Office publishes regularly updated travel information on its website www.fco.gov.uk/knowbeforeyougo which we strongly recommend you consult before booking and in good time before departure.

We are not responsible for delays outside our control. If your Adventure is delayed or postponed by an event outside our control (including, but not limited to, any epidemic, pandemic, disease or travel restrictions arising from any such occurrence) then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for your booking, subject to our right to our right to retain an appropriate and justifiable termination fee (together with any third party costs incurred by us up to that date in arranging and booking your Adventure).

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services provided by us. 

We only book tours for domestic and private use. If your tour is for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

  1. Your Adventure Price and Payment for your Adventures

We reserve the right to alter the prices of any of the Adventures or travel arrangements shown on our website or elsewhere at any time before we confirm your booking in accordance with clause 2. You will be advised of the current price of your Adventure before your booking is confirmed.  We take all reasonable care to ensure that the price of your Adventure advised to you is correct. However, it is always possible that despite our best efforts, some components of your Adventure may be subject to change by third party suppliers or may be incorrectly priced. Once confirmed at the time of booking, the price of your Adventure is fully guaranteed and will not be subject to any surcharges.  No discounts or refunds for unused services will be given, if at the time of booking, prior to departure or during your Adventure, you or any member of your party choose not to take part in the full package as detailed in the Trip Notes.

Please note that accommodation arrangements are subject to availability. We will contact you within 5 – 7 working days of your booking to confirm your requested accommodation or to provide alternative options to you.

We accept payment through BACS Pyment (Bank transfers) for your Adventure if due as follows:

  • A non-refundable deposit  of the adventure for flight confirmationis payable immediately upon us issuing your booking confirmation;
  • A further balance of the full cost (detailed in the booking confirmation) minus the deposit is payable on the date 3 months later with the final balance payment due 14 weeks prior to departure date.
  • The balance of all monies due, including any surcharges applicable at that time, is payable  not later than 90 days before the departure date;
  • For Adventures booked less than 90 days prior to the departure start date, 100% of the price is payable immediately upon us issuing your booking confirmation.

If payment is not received by the due date, you may be liable for to pay our cancellation fees in accordance with clause 10. Balances can only be paid in the same currency as your deposit. If you do not pay the full balance by the due date, we reserve the right to cancel your booking in which case we will be entitled to retain the deposit paid or payable at that stage.

  1. The Importance of Travel Insurance

It is the responsibility of each individual member of your party that they have appropriate travel, health, accident, luggage, and trip cancellation insurance. Many of the third-party suppliers who will supply the travel, accommodation and activities which form part of your Adventure will seek to exclude liability for any loss or damage suffered by you or to your personal belongings.  We are not responsible for any such loss or damage suffered by you (see further clause 3 above on our responsibility to you) and it is your responsibility to arrange appropriate insurance to cover you for any such loss or damage.

  1. Age, Fitness and Participation

All individual members of the booking must satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen Adventure as described on the website or in the itinerary. No unaccompanied minors (those under 18 years of age) can be accepted on Adventures operated by LTA however minors can accompany their parents or guardian on Adventures operated by LTA. Participation of minors in the activities is subject to age restrictions. You can make a request for alternative activities to be booked that are suitable for minors. This is subject to an administrative fee of £50 for each change in activity that is requested. In addition, you will be liable for any additional costs incurred by us as a result of changing an activity on your Adventure.

If in the opinion of LTA or any such person operating or managing any aspect of the Adventure, the health or conduct of a member of a booking before or after departure appears likely to endanger the safe, comfortable, or happy progress of an Adventure, you may be excluded from all or part of the Adventure without refund. In the case of ill health LTA may make such arrangements as it sees fit and recover the costs from you.  It is your responsibility to ensure they seek professional medical advice before travelling and to be aware of and to take all necessary health precautions and preventative measures.

  1. Assistance whilst you are on your Adventure.

In the event you end up in difficulty (of any sort) during your Adventure, our ground handler will provide you with appropriate assistance as soon as reasonably possible including by the provision of appropriate information on health services, local authorities and consular assistance and by assisting you to make distance communications and to find alternative travel arrangements as may be applicable. Where you are in difficulty as a result of your negligence, we may charge you a reasonable fee for this assistance which will not exceed the costs we actually incur.

  1. Special Requests and Medical Conditions/Disabilities/Reduced Mobility

If you have any special request (which includes special requirements), you should advise us prior to booking. We regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your own protection, you should obtain confirmation in writing that a special requirement will be complied with (where it is possible for us to give this) if it is important to you. Any special requirement which we have accepted will be specifically confirmed as accepted on your confirmation invoice.

Given the certain degree of physical effort required, our Adventures may not be suitable for people with certain disabilities, medical conditions, or significantly reduced mobility. Before you make your booking, we will advise you as to whether the proposed Adventure arrangements are generally suitable for someone with reduced mobility. However, reduced mobility of course means different things to different individuals as we fully appreciate that individual capabilities, restrictions and requirements are likely to vary considerably. When we refer to reduced mobility, this means any material reduction in mobility whether this is permanent or temporary and whether caused by age or by physical or mental disability or impairment or other cause of disability.

Should you suffer from any medical condition, disability or significant reduction in mobility which may affect your Adventure (including any which affect the booking process) or have any special requirements as a result, please tell us before you confirm your booking so that we can assist you in considering the suitability of the arrangements and/or making the booking. In any event, you must give us full details in writing at the time of booking and whenever any material change in your condition, disability or mobility occurs. You must also promptly advise us if any medical condition, disability or reduced mobility which may affect your Adventure develops after your booking has been confirmed.

You must ensure that your travel insurers are aware of any medical condition, disability or reduction in mobility you suffer from and have agreed that this will be covered by your policy. We may ask you to provide us with evidence of this. Please also read “Choosing the right Adventure” in our Booking Information.

  1. Your commitment to us at LTA

Where you book an Adventure through an authorised travel agent of ours all monies you pay to that travel agent are held by him on your behalf until a contract between us comes into existence. After that, such monies will be held by the agent on our behalf until they are paid to us.

If you wish to make a change to your booking after we have confirmed it, please contact us.  We will make every effort to accommodate changes you wish to make to your Adventure where we are able to and will let you know if the change is possible. If it is possible we will let you know about any changes to the price of your Adventure, your itinerary or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.  Where there is any additional balance payable for any changes made, these must be settled along with payment of the balance of your tour price under clause 3, or if the balance has already been paid, immediately on us issuing confirmation to you of the change.

 

  1. Cancellation of your Adventure by You

You may cancel your confirmed booking at any time prior to departure. Where you wish to do so, written notification must be sent to us by recorded delivery post or by email. If your notification is provided by email, as proof of receipt you must ensure you receive and retain written acknowledgement from LTA.

If you wish to cancel your booking, you will be charged a cancellation fee as follows:

You acknowledge and agree that the foregoing charges arising on termination appropriate and justifiable termination fee, reflecting the limited availability and specialist nature of the travel arrangements being provided.

We will refund any sums due to you as soon as possible following cancellation by the method you used for payment. However, we may make deductions from the amount refunded, as provided for above.

  1. Cancellation of your Adventure by Us

LTA reserves the right to cancel an Adventure at any time by writing to you if you fail to pay the final balance to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due.

If we end the contract in the situation set out above, we will return all monies paid but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract, and any third party costs incurred by us up to that date in arranging and booking your Adventure. We shall not be liable to you for any incidental expenses incurred by you as a result of any arrangements that you may have made.

We reserve the right to alter or cancel all, or part of the Adventure if a Force Majeure Event arises. Should we exercise this right, we shall use its reasonable endeavours to re-book the Adventure. Notwithstanding the foregoing, if we cannot agree a date to re-book the Adventure, we shall not be required to refund any fees paid to you.

For the purpose of these booking terms, a “Force Majeure Event” means any circumstance not within a party’s reasonable control including, without limitation:

  • acts of God, flood, drought, earthquake or other natural disaster.
  • epidemic or pandemic (including but not limited to COVID-19 or any other such variation of COVID-19);
  • terrorist attack, war, threat of preparation of war, embargo imposition of sanctions.
  • nuclear, chemical, or biological contamination.
  • any law or any action taken by a government or public authority.
  • collapse of buildings, fire explosion or accident.
  • interruption or failure of utility service.
  • adverse weather conditions

Neither party shall be in breach of the contract not liable for delay in performing, or failure to perform any of its obligations under this contract if such delay or failure results from a Force Majeure Event, circumstances or causes beyond its reasonable control.

  1. Changes by us

LTA reserves the right at any time to cancel or change any aspect of your Adventure. This may include adjustments to the facilities, services or prices described on the website and in the agreed itinerary (including transport, accommodation, excursions, or other arrangements). Where we are unable to arrange the supply of a particular individual component of your Adventure, we will make reasonable effort to substitute alternative arrangements of comparable monetary value and quality at no additional cost to you and will refund any difference in price which arises as a result of the arrangement of such alternative provision. 

  1. Passport & Visa Requirements

It is the responsibility of each individual member of your tour party to ensure that they possess all the necessary documentation for travel, entry into the countries visited and access to all Adventures.  This will include passports, tickets, visas, medical certificates, and any other relevant travel documentation. We will not be liable for any denial of entry, access, or refusal of service by any third party due to lack of any such required personal documentation. If failure to have any necessary documentation results in fines, surcharges or other financial penalty being imposed on us or costs or expenses being incurred by us, you will be responsible for reimbursing us accordingly.   1. Foreign Office advice 

The UK Foreign Office publishes regularly updated travel information on its website www.gov.uk/foreign-traveladvice and https://travelaware.campaign.gov.uk/ which you are strongly recommended to consult regarding your country of travel.

  1. Excursions

Please note that we do not provide or arrange excursions other than those listed in your itinerary in BOLD and forming part of the arrangements booked and paid for in the UK. We cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which any supplier agrees to provide for you where the services or facilities are not advertised by us and we have not agreed to arrange them as part of our contract and any optional activities, excursions, or other tours you purchase during your Adventure.

  1. Assistance during your Adventures

  1. Unavoidable and extraordinary circumstances

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by, or you otherwise suffer any damage, loss, or expense of any nature, as a result of, unavoidable and extraordinary circumstances. In these booking conditions, unavoidable and extraordinary circumstances mean a situation which is beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Such situations are likely to include (whether actual or threatened) war, riot, civil strike, terrorist activity, industrial dispute, natural disaster, adverse weather conditions, fire, flood, an outbreak of a serious illness at your Adventure destination, closure, restriction or congestion of airports, other transport hubs or airspace, flight restrictions imposed by any regulatory authority or other third party and volcanic activity.

  1. Local Laws

All participants in Adventures are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve LTA of all obligations that they may otherwise have under these booking conditions.

  1. Transfer of person travelling on booking

LTA accepts the clients right to transfer their place on their booking to another person (introduced by the client) provided the person to whom the place is to be transferred satisfies all conditions which form part of your contract with us. Requests for a transfer must be made not less than 7 days before departure and must be accompanied by the name and other applicable details of the person(s) who will replace the client. Where the transfer can be made, all reasonable costs and charges incurred by us and/or incurred or imposed by any of our suppliers as a result together with an amendment fee of £50.00 must be paid before the transfer can be affected. Any overdue balance payment must also be received.

  1. GDPR Statement

LTA takes the collection, processing, and management of customer data very seriously. The company strives to be fully UK GDPR compliant, and we routinely review our data management policies. We have measures in place to protect the personal booking information held by us and passed on to the relevant suppliers of your travel arrangements. These may include public authorities such as customs and immigration along with security or credit card services. If you travel outside the European Economic Area (EEA), controls on data protection may not be as strong as those within the EEA. Unless required to do so by law, we will only pass on your information to persons responsible for your travel arrangements where it is necessary to fulfil our contract with you. Information may include sensitive information such as details of disabilities, dietary or religious requirements.   1. Promotional Images

Subject to your consent, you may appear in photos or videos which are taken on any of our Adventures, whether by a member of our team, suppliers or other clients. In accordance with our privacy notice, these may be used by us without payment in any media (whether now existing or in the future invented) for bonafide promotional materials of any kind, such as in brochures and website slides and videos. You will not be identified by name in any material.

  1. Complaints

Should you have any complaints about any aspect of your Adventure arrangements, you must inform our local representative or tour leader immediately and the supplier of the arrangements concerned. Problems can most easily be dealt with on the spot.  Please note, if you do not report a problem or complaint which, if it had been reported at the time it occurred could have been resolved there and then we cannot accept any liability in respect of that problem or complaint. It is sensible to expect a client travelling in the developing world to be reasonably resourceful if things go wrong.  If the issue cannot be resolved locally you can contact us in the UK on our 24-hour emergency telephone service. You will be provided with the 24-hour emergency telephone number prior to travelling. In the unlikely event that an acceptable solution cannot be found, you should then write to us within 28 days of your return with full details of your complaint giving your booking reference and all other relevant information. If you fail to follow this complaints procedure, your right to claim the compensation you may otherwise have been entitled to may be affected or even lost as a result. If we cannot reach an amicable solution to any dispute you do have the right to refer the dispute to the Association of Independent Tour Operators which operates an Independent Dispute Service (details on request) for resolution of the dispute by a mediator provided the claim does not involve personal accident, injury, or illness.

  1. General

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. These terms are governed by Scottish law and you can bring legal proceedings in respect of your tour in the Scottish courts.5-7for booking fo flights
